A no win no fee accident claim refers to a legal arrangement in which an individual can make a personal injury claim without having to pay any upfront legal fees. Instead, the legal fees are paid at the end of the case by the opponent and only if the claim is successful.

What is No Win No Fee?

The legal term for no win no fee is Conditional Fee Agreement (CFA). A no win no fee personal injury claims means that you can proceed with an accident and injury compensation claim knowing that if the claim ends unsuccessfully, you don't pay any money to the solicitors.

Claims where we can recover our fees - even if the injury is worth less than £5,000

We can recover our fees from your opponent if the following exceptions apply.

Your injury claim is likely to be worth more than £5,000 or £1,000 if you are a "vulnerable road user"

The following are vulnerable road users :-

  2. Cyclist
  3. Pedestrian
  4. Horse rider
  5. Using a mobility scooter at the time of the accident
  6. A child or a Protected party (a person under a disability without capacity to make financial decisions).
  7. An undischarged bankrupt
  8. The claimant or Defendant is deceased
  9. The Defendant's vehicle registered outside UK

Injuries worth more than £5,000

If you do not fall into any of these categories and you have suffered other injuries, over and above a whiplash injury, for example, a sprain to a wrist, hand, elbow, knee, ankle, foot, fractured ribs, hearing loss, tinnitus and they are considered to be more serious than a simple whiplash injury, your claim may well be worth more than £5,000. A fracture to any bone is likely to justify an award in excess of £5,000. In that case, costs should be recoverable.

The only deduction from your no win no fee compensation would be our success fee of 25%. If the injured party is a child or a person who lacks capacity to mange their own financial affairs we will not charge a success fee.
