Forbes has considerable experience in assisting in the drafting of suitably worded letters at the pre-action stage which, when combined with the appropriate visits, should prove effective in securing the requisite defence pursuant to regulation 39. Forbes is able to advise on the most meritorious means of attempting to gain access to the property. In line with the Key Lines of Enquiry, Forbes recommend the use of injunctive proceedings and have developed a range of standardised documents which facilitate a swift turnaround once attempts to gain access to the property by you as landlord have been exhausted. Where it is felt that the injunctive route may not be the most appropriate, Forbes is able to advise on the most suitable alternative route for possession. Forbes has experience of securing full possession order for non compliance with a tenancy agreement for failure to allow access for gas servicing. Forbes is also able to offer advice on the potential for the use of warrants to gain access pursuant to the Environmental Protection Act 1990.
