Are You A Tenant Requiring Early Termination Of Your Commercial Lease?

If there is no express lease provision allowing you to do so then you can consider the following possibilities:

Firstly, consider contacting your Landlord to see if they will agree to terminate the Lease.

Secondly, is there a break clause?  These clauses allow for early termination at certain periods in the Lease.  If this is an option make sure you have complied with any specific obligations such as rent payment and observing tenant covenants.

Thirdly, does the Lease permit assignment?  If so you can assign your interest to another party, however, the Landlord may still require you to act as a guarantor.

Finally, does the Lease permit subletting?  Be aware that if you sublet you will still remain responsible for rent payment under the Head Lease.
