Fundamental dishonesty - a tactical overview
Chris Booth - Forbes Solicitors

Chris is a Partner and joint Head of the firm's Insurance Department as well as Head of the firm's Anti Fraud Team. Chris is also a member of the Insurance Department's Retail Group. Despite the passing of a number of years since the concept of Fundamental Dishonesty was first introduced, there is still limited consistency on the procedural aspects of securing a finding of Fundamental Dishonesty. With reference to specific cases, we will discuss our experiences of the courts and of Claimants and provide advice on evidence gathering, strategy and ensuring that the retail sector is best placed to safeguard against dishonest claims.


HSE Sentencing Guidelines
Andrew Ellis - Forbes Solicitors

Andrew is the Managing Partner of the firm's Manchester office. The Sentencing Council has issued guidelines to be used by Judges when sentencing for corporate manslaughter, health and safety offences and food safety and hygiene offences. The Health and Safety Offences, Corporate Manslaughter and Food Safety and Hygiene Offences Definitive Guidelines were produced following a review of sentences in corporate manslaughter and health and safety convictions. Andrew will explain how the courts decide the appropriate sentences to apply, both in relation to offences committed by organisations and in relation to offences committed by individuals using case studies to show the sentencing that has been handed down against organisations and individuals.




Combatting Claimant Portal Tactics and dealing with Stage 3
Warren Smethurst and Hayley Lloyd Henry - Forbes Solicitors

Warren is a Legal Executive in our Insurance Department at our firm's Manchester office. He deals with retail liability claims of all types and is part of the anti fruad team.

Hayley is a Solicitor in the Insurance Department at our Leeds office. She has experience of defending Public and Employers' Liability claims and acts for a number of different clients.

Hayley and Warren will provide insight into the latest tactics from Claimant's solicitors in relation to low value personal injury claims, and tips on how to combat them.




Dan Milnes - Forbes Solicitors

Dan is a partner and head of the commercial team and has extensive experience in advising public and private sector clients on a wide range of contractual matters and issues relating to governance and compliance.

GDPR is coming in May 2018 and Brexit won't change that. What risks and potential claims does it create in the retail sector and how will the new law affect the use and abuse of data protection in claims handling and litigation? This session will get past the hyperbole about GDPR and assess what you should consider between now and May.
