Guidance Document to Supplement New Highways Code of Practice Released

The Institute of Highway Engineers (IHE) have today launched a revised guidance document on Highway Risk and Liability titled "Well-managed Highway Liability Risk".

Following the publication of the UKRLG Code of Practice document "Well-managed Highway Infrastructure", the IHE was asked to review and update the current guidance on Risk and Liability. The guide is intended to support and provide supplementary advice to highway authorities.

The principle of Well-managed Highway Infrastructure is that highway authorities will adopt a new risk-based approach in accordance with local needs, priorities and affordability. The guidance therefore aims to provide practical guidance on applying a risk-based approach.

In addition, the guidance also:

  • sets out the main statutory provisions and case law that provide the core principles on which highway claims are considered;
  • provides an overview of the claim process, discusses fraud, and the importance of recording and capturing claims management information to support a risk-based approach to highways asset management;
  • provides guidance on training and assessment of competence of relevant personnel;
  • provides guidance on information management and record keeping; and
  • reviews some of the issues relating to transfer of liability risk when services are outsourced.

This Guide will be of real assistance when Highways Authorities are considering their approach to the new Code and should be read in conjunction with the Code itself.
