With effect from 1 April 2017, the fee payable to the Office of the Public Guardian to register a Lasting Power of Attorney (or an old-style Enduring Power is Attorney) has been reduced from £110 to £82.
A Lasting Power of Attorney (LPA) is a legal document that allows you to appoint one or more people (known as your 'Attorneys') to make decisions on your behalf. You can only make an LPA whist you still have mental capacity.
A Financial Decisions LPA enables your attorney to make decisions on your behalf in relation to your financial affairs and your property, including running your bank account, selling your property or paying bills on your behalf. Once registered, the Financial Decisions LPA can be used by your Attorneys at your direction, and can continue to be used in the future if you lose the mental capacity to make decisions for yourself.
A Health and Care Decisions LPA enables your attorneys to make decisions about medical treatment and social care, including what treatment you receive, where you should live and decisions concerning life-sustaining treatment. The Health and Care Decisions LPA can only be used by your Attorneys if you have lost capacity to make those types of decisions for yourself.
The two types of LPA are independent of each other.
The Government hopes that reducing the registration fee will encourage more people to make LPAs. LPAs can provide peace of mind that your affairs will be managed by your chosen Attorneys in the event that you became incapable of managing for yourself.
