No-fault divorce to start in autumn 2021

The end is now very much in sight for those who have been calling for reform to our fault-based divorce process. On 25 June 2020, the Divorce, Dissolution and Separation Bill received Royal Assent.

Resolution have been campaigning for a modernisation to the law of divorce for decades and their National Chair, Margaret Heathcote, has welcomed today's news commenting that the reform will allow its members "to resolve matters as constructively and amicably as possible, minimising the impact on any children they may have." A view that is shared across the profession.

It is though to be noted that it is unlikely that we will see the no-fault divorce in operation until early 2022. Lord Chancellor Robert Buckland said that "at this early stage, we are working towards an indicative timetable of implementation in autumn 2021."

We have been watching the progression of the Bill very closely and the reform that it is set to bring in is very welcome. So although we have a little longer to wait before we see these changes in practice, it is to be celebrated that change is now finally coming.
