A Family Solicitor at Forbes is backing comments made by a leading family figure to radically shake up the Divorce process.
Sir James Munby, President of The Family Division, has raised doubts as to whether Divorce should remain a matter for the Courts to deal with and suggested that the time has come to consider removing fault as a basis for Divorce and rely on irretrievable breakdown as the sole ground.
Dawn Baker, Family Solicitor at Forbes comments, "About time! At present most separating couples have to use blame to start the process of ending their marriage, which is both unsettling and upsetting for both parties, and is also inconsistent with the governments requirement that the parties should mediate."
"Putting the couples in a room with each other, expecting them to try to discuss and resolve all other money and/or children issues when one party has just started a divorce blaming the other's behaviour or adultery is likely to test the skills of even the most competent of mediators! Reform is very badly needed and has been for many years."
