The Queens Speech confirms the Government's Commitment to Whiplash and Court Reform

The Queens Speech at the State Opening of Parliament confirmed that the government remains intent on tackling the compensation culture and amending the Court system.

Despite shelving some of the promises contained in the Conservative manifesto, the Queen announced that a Civil Liability Bill will be introduced to crack down on fraudulent whiplash claims and to reduce motor insurance premiums. The Bill contains proposals previously included in the abandoned Prison and Courts Bill such as a ban on pre-med offers and a fixed tariff of compensation for whiplash injuries lasting up to two years.

A Courts Bill will also be introduced aimed at reforming and modernising the court system in England and Wales and is likely to include the first steps towards a digital online court for civil claims.

The speech also included the announcement of a data protection bill, to implement the EU General Data Protection Regulation.

Although Brexit dominates the government's agenda, the inclusion of the Civil Liability Bill confirms the government's commitment to tackling the compensation culture.

The small claims limit will still be increased as planned on 1^st October 2018 by way of amendment to the CPR. The small claims limit for road traffic matters will be increased from £1,000.00 to £5,000.00 on 1 October 2018 and for other personal injury claims to £2,000.00.
