Rise in Employment Tribunal Claims

The annual statistics for 2009/2010 have just been published by the Tribunals Service. They show the usual increase in the workload of the Tribunal, which is increasing year on year. The highlights:

  • An increase in the amount of claims being lodged at Employment Tribunals; up by 56% compared with 2008/2009.
  • A record number of claims was therefore dealt with in 2009/2010.
  • A increase of 17% in the number of Tribunal claims connected with unfair dismissal and redundancy. This is likely to be as a result of the economic recession.
  • 400,000 claims presently await being finally decided by the Tribunal.

This increase, which has been seen year-on-year for some time now, demonstrates an increased awareness of the employment rights of individuals, together with an increase in the rights available to those individuals.

The maximum award for unfair dismissal cases in the Employment Tribunal presently stands in excess of £60,000; and the compensation available for discrimination cases is unlimited.

The new statistics therefore serve as a timely reminder to all employers to treat employment issues very carefully and to seek specialist advice on any employment issue at an early stage.
