Forbes Solicitors' Employment Team is warning those who regularly employ agency workers to be prepared for tough new legislation which is due to come into force on 1st October 2011.
The Agency Workers Regulations will entitle those working through an agency to the same basic working and employment conditions, following 12 weeks on an assignment, as if they had been recruited directly by the firm. From day one of their assignment agency workers will be entitled to the use of facilities that comparable employees can access, for example, car parking, canteen and childcare.
Amy Stokes, Employment Solicitor at Forbes Solicitors, comments, "It seems safe to say that the landscape of agency workers entitlements is changing and businesses need to know their obligations as there is likely to be an increased burden on administrative resources. Employers who fail to comply with the regulations are leaving themselves open to employment tribunal claims and potential financial implications."
