Welcome to Forbes’ quarterly Manufacturing & Engineering Sector eNews. 

Whilst the immediate impacts of Covid seem to be relinquishing and businesses learning how to manage with driver and supply shortages, there appears to be no rest for the sector with geopolitical challenges most recently causing soaring costs.  The volatility of the market is greater than ever and at the end of the last quarter, following a series of discussions with clients across the sector, I wrote that we were hoping to see light at the end of the ‘challenges’ tunnel.

Whilst rising costs to businesses pale into comparison with the troubles with are being experienced elsewhere, this makes it no less a challenge to have to deal with.  In the past month we’ve advised clients on a range of issues indirectly attributable to the rise in fuel prices, shortage in supplies and the war in Ukraine.  Some examples include:

Suppliers looking to take advantage of the war to excuse non or delayed performance and invoke force majeure in an illegitimate manner; and

Price hikes due to ‘events beyond their control’ notwithstanding contractual mechanisms for the variation of prices being set out.

Some of this merely reiterates not only the importance of getting the contract right in the first instance but referring back to it where something just seems not right or reassurance is sought.  Our Business Immigration team are offering free-of-charge consultations to help both individuals and organisations apply for the UK’s Ukraine visa schemes. Smart Contracts shall we embrace them or hold off for now?

Smart contracts are said to be the next revolution of contracts. Although a smart contract sounds like a legal instrument, a smart contract is actually a computer program that performs a task when triggered by the occurrence of a predetermined event. Smart contracts live on blockchain, which processes the terms of the smart contract, thereby enabling the smart contract to automatically execute the coded task when the triggering event occurs.

Drug and alcohol misuse at work

Royal Mail has recently launched an investigation after footage appeared to show postal workers under the influence of drugs. According to a caption, the workers accidentally ate 'hash brownies' and had to be helped because of the impact the drugs had on them. The video claims staff ate the brownies between 5.30am and 7.30am. The undelivered parcel, marked "Edibles by Pablo Chocobar" was said to have gone uncollected for a month.

 

Commercial Property - The Road to Net Zero?

In our previous edition we wrote about "green" leases and how the parties to a lease may seek to agree terms in a lease or side agreement that focus on improving the environmental position of a building. The parties (particularly a landlord) may simply be motivated by a desire to meet regulations with regard to minimum energy efficiency standards (MEES), to achieve an Energy Performance Certificate (EPC) rating for the building that at least meets the government's minimum requirements.
