Update on the Extended 
Eviction Ban

 

The Public Health (Coronavirus) (Protection from Eviction) (England) Regulations 2021 are now available.

Sadly the one and only amendment, save for the expiry date (see earlier e-brief), appears to be in relation to rent arrears.

Whereas previously there had to be over 9 months worth of arrears there now only needs to be 6 months and there is no longer any requirement for these arrears to have accrued before 23 March 2020.

As such the court should grant your request for a warrant where the arrears are over 6 months regardless of when those arrears arose.

We shall see if this actually results in any evictions.
