Forbes Solicitors successfully secured a £25,000 settlement for a client pursuing a claim under the Inheritance (Provision for Family and Dependants) Act 1975 after being excluded from his late mother’s Will.

The estate, valued at approximately £340,000, had been left into a trust for the benefit of other family members, including a disabled sibling. Our client, an adult child of the Deceased, suffered from significant physical and mental health difficulties, relied on state benefits, and had no meaningful financial security.

The matter involved a number of complex issues, including long-term family estrangement, competing beneficiary needs, and the interaction between the estate and an external trust structure.

Forbes Solicitors prepared detailed pre-action correspondence, financial evidence, and medical evidence in support of the claim, whilst taking a commercially focused approach to settlement negotiations.

Following negotiations with the executors and trustees, the matter was successfully resolved without the need for court proceedings, securing a £25,000 settlement for the client and avoiding the costs and uncertainty of litigation.
