Delayed Cancer Diagnosis Leads to £52,000 Payout for Missed Tumour
Forbes Solicitors has secured a £52,000 settlement for a Claimant following a delayed diagnosis of bowel cancer, which resulted in a lost years claim.

In February 2018, a CT colonoscopy failed to detect a tumour. The error was not identified until late 2021. Medical expert evidence supported that the nearly four- year delay in diagnosis reduced the Claimant’s life expectancy by almost three years.
Although the tumour was slow-growing and the Claimant remained mostly asymptomatic, the delay led to the cancer progressing to a more advanced stage. This necessitated unnecessary adjuvant chemotherapy and resulted in a slightly reduced survival rate.
The required hemicolectomy would have been necessary regardless of the timing of the diagnosis.
The Claimant continues to have a good prognosis; and as a self employed individual, they did not suffer any loss of earning or pension.
After the error was discovered, the Claimant instructed Forbes Solicitors to pursue a clinical negligence claim for the delayed diagnosis. Liability was admitted, and judgement was obtained. However, the Claimant was required to prove the extent of the harm caused by the delay.
The case involved comprehensive expert input across four medical disciplines: radiology, oncology, psychology, and histopathology.
