The Claimant was a patient who first sought medical advice in 2016 after experiencing persistent sinus problems, a sore throat, abscesses and ongoing voice loss. Prior to their diagnosis, the Claimant led an active lifestyle and had worked for over three decades in a physically demanding role within a noisy industrial environment.

From around March 2016, the Claimant attended their GP on multiple occasions reporting ongoing and unusual symptoms. Although medication provided temporary relief for sinus issues, the Claimant continued to lose their voice over a 12-month period. Concerned that their symptoms were not being properly investigated, the Claimant sought a second opinion at a local hospital.

Despite the GP raising concerns and requesting a referral, this was not progressed in a timely manner. During the delay, the Claimant’s condition deteriorated significantly, including episodes of coughing up blood. A formal referral was eventually made several months later. Following investigation, including a camera examination, the Claimant was diagnosed with throat cancer.

The delayed diagnosis resulted in advanced throat cancer, requiring significant surgical intervention. The Claimant initially underwent surgery to reduce a tumour that was obstructing approximately 80% of their airway. However, the tumour rapidly returned, necessitating a full laryngectomy.

As a result, the Claimant permanently lost their voice box and now relies on a medical device to communicate. This has had a profound impact on their independence, daily activities and quality of life. They are unable to communicate verbally when their hands are occupied and face significant challenges in social environments.

The Claimant can no longer pursue their previous employment due to the inability to raise their voice in a noisy workplace. Hobbies such as attending concerts, swimming and water sports are no longer possible due to medical risks. Everyday activities have also been affected due to reduced strength and nerve damage following surgery.

Feeling that their concerns had been ignored and that appropriate care was not provided, the Claimant instructed Forbes Solicitors to investigate a potential clinical negligence claim. Leonie acted on behalf of the Claimant, guiding them through the legal process and explaining each stage clearly.

The claim focused on failures in referral and investigation, resulting in a delayed diagnosis and avoidable deterioration of the Claimant’s condition. Medical evidence was obtained to support causation and the impact of the delay. Following negotiations, the claim concluded successfully.

The Claimant secured a substantial settlement, reflecting the severity of the injury, the life-changing impact of the delayed diagnosis and the financial consequences of being unable to continue their previous employment.

The compensation has enabled the Claimant to set up a new business, regain a degree of independence and plan for the future with greater security. Leonie’s support throughout the case was described by the Claimant as clear, reassuring and expert.

This case highlights the importance of timely referral and investigation where patients present with persistent or worsening symptoms. Delays in diagnosis can have devastating and irreversible consequences.

Patients are entitled to expect that their concerns will be taken seriously and escalated appropriately. Where this does not happen, legal advice can help secure accountability and provide vital support for the future.
