Employment Rights Bill roadmap: reforms for the education sector
The Government have now published their “roadmap” for implementing the provisions contained in the Employment Rights Bill (ERB). The ERB is now in the final stages of the Parliamentary process, and we expect the ERB to receive Royal Assent when Parliament return from their summer recess.

From an education perspective, it is worthwhile noting that the timetable for implementation clarifies that the “1” right to claim unfair dismissal will not take effect until 2027, with the same timeframe being applied to the introduction of protections against zero hour contract abuse. Whilst the government have confirmed the consultation on the reinstatement of the School Support Staff Negotiating Body will be launched shortly, the reinstatement of this negotiating body does not appear on the roadmap for implementation. It is unclear if this has been omitted in error, or if the outcome of the consultation will determine if this will be reinstated at all – we will await the outcome of the consultation with interest.
It is reassuring to note that the Government have committed to using “common commencement dates” to commence the “majority” of regulations laid using the powers provided for in the Bill. These dates will be the 6th April and the 1st October, which should assist in there being less of a piecemeal / scattergun approach to reform. However, there are still a significant amount of changes for organisations to keep abreast of, particularly as many reforms will take place in the form of codes of practice or guidance.
