The claimant was cross a yard when they tripped as a result of a rope that had placed across the yard to direct others away from the area. There was a failure to make the rope conspicuous enough or to place any warning signs to warn people of its presence. The claimant didn’t see it and fell.

 Making the personal injury claim

Following the accident, the claimant contacted Forbes Solicitors to make a claim for the accident they had suffered at work. When Forbes Solicitors contact the Defendant, the Defendants failed to respond to the claim initially. Primary liability was admitted some 6 months later. The defendants argued the value of the claim should be reduced by 25% to reflect contributory negligence as a result of the Claimant failing to see the rope. A counteroffer was made and a liability split of 85/15 was agreed in the Claimants favour. The case was listed for trial. The claimant accepted an offer to settle.
