How to apply for a sponsorship licence

Usually, you would apply for a sponsor licence in order to sponsor foreign workers or students from outside the UK to come and work or study in the UK. This also includes citizens of the EU, Iceland, Liechtenstein, Norway and Switzerland who arrived in the UK after 31 December 2020.

The exceptions are to those who are:

  • Irish citizens;

  • Those with settled or pre-settled status under the EU Settlement Scheme; or

  • Those with indefinite leave to remain in the UK

As an employer that wishes to apply for a sponsorship licence, it is vital that you adhere to what is required otherwise you will be at risk of the licence being suspended and/or withdrawn. Please note that you cannot appeal if your licence is withdrawn, but you can reapply – having to wait at least 12 months before reapplying.

As such, you must ensure that the workers you wish to sponsor have the applicable skills and/or qualifications that are required (and copies of the evidence is kept safe). It is therefore important that you seek legal support during the application process.

In order to apply, you must:

1.      Ensure your business meets the Home Office criteria, so it is eligible;

2.      Ensure the job is suitable for the sponsorship;

3.      Decide the type of licence you wish to apply for – pursuant to the type of worker you wish to sponsor;

4.      Collate all necessary documents that prove your business’s legitimacy, financial stability and ability to comply with sponsorship obligations;

5.      Apply online and pay the applicable fee;

6.      Await the decision from Home office;

7.      If applicable, a digital inspection of your business premises will be conducted; and lastly

8.      Notification of your decision will be provided.
