Lasting Powers of Attorney: A Christmas Gift for your Future Self

The festive season often reminds us of the importance of family and loved ones, and it is a time when we reflect on how we want to provide for those closest to us. One of the most thoughtful gifts you can give yourself and your family is a Lasting Power of Attorney (LPA).

What is an LPA?

An LPA is a legal document that allows you to appoint someone you trust (also known as your “attorney”) to make decisions on your behalf, if you are incapable of doing so due to a physical restraint or due to illness or incapacity. Setting up an LPA is a step you can take now to ensure that, should the unexpected happen, your financial and healthcare decisions are in the hands of someone you trust.

There are two main types of LPAs:

  1. Property & Financial Affairs LPA – this allows your attorney(s) to make decisions about your financial matters, such as paying bills, managing bank accounts or even selling property.

  2. Health & Welfare LPA – this allows your attorney(s) the authority to make decisions about your healthcare, where you live and your daily care. If you allow, it also lets your attorney(s) make decisions regarding medical and life sustaining treatment.

Why do you need an LPA?

You may think that setting up an LPA is something you can put off for another day, but waiting could have serious consequences.

Here are some reasons why setting up an LPA is essential:

  • Control over your future decisions – one of the biggest benefits to setting up an LPA is the peace of mind it offers knowing that there’s someone legally authorised to manage your affairs on your behalf.

  • Life is unpredictable – accidents, illnesses, car crashes or sudden medical conditions like strokes, brain injuries or even a mental health crisis can happen to anyone and can leave you unable to manage your affairs.

What happens if I don’t have an LPA?

If you lose mental capacity without an LPA in place, your loved ones will not automatically have the legal right to make decisions for you. It is likely that your loved ones will have to go to the Court of Protection to obtain the authority to make decisions to act on your behalf, which is time consuming, expensive and emotionally draining for all those involved. Setting up an LPA gives YOU the control over who you want to make decisions for you.

Why choose a solicitor to set up your LPA?

Navigating the complexities of an LPA document and understanding the legal consequences can be challenging without legal experience. A solicitor who specialises in setting up LPAs can guide you and help you consider and understand your unique needs. They can help you make the right decisions ensuring that the LPA reflects your wishes and intentions.

A solicitor will:

  • Advise on selecting attorneys.

  • Offer guidance on difficult or unique situations.

  • Offer ongoing support and explain how your LPA fits within your broader estate or financial planning.

  • Clarify the terms and conditions of the LPA wording.

  • Deal with complex or complicated situations – for e.g. if you own a business, have a blended family or have international issues.
