£1.5 Million Settlement Secured for Passenger in Serious Road Traffic Accident Claim
Forbes Solicitors has secured a £1.5 million settlement for a claimant who suffered life-threatening injuries as a passenger in a road traffic accident. The case highlights the serious long-term impact of traumatic brain injuries and the importance of resisting early settlement offers.

The accident occurred in 2023 when the Claimant was travelling as a front seat passenger in a motor vehicle.
During the journey, the driver lost control of the vehicle, resulting in a collision with a building.
The Claimant suffered multiple severe injuries, including: a traumatic brain injury with intracerebral haemorrhage and diffuse axonal injury, fractures to both legs and ribs and long-term physical and cognitive consequences.
As a result of these injuries, the Claimant was left with a permanent limp and ongoing mobility issues, particularly when placing strain on their legs. They also experienced lasting cognitive difficulties, including poor memory and problems with concentration.
Following the accident, the Claimant instructed Forbes Solicitors to pursue a personal injury claim.
When liability was investigated, the Defendant’s insurers accepted primary responsibility for the accident. However, they raised issues around whether the Claimant had been wearing a seatbelt and the potential involvement of drugs.
These arguments were significant, as they could have led to a reduction in compensation on the basis of contributory negligence.
The insurers made a number of early settlement offers in an attempt to resolve the claim quickly. These were carefully considered and ultimately declined, as they did not adequately reflect the severity of the Claimant’s injuries and long-term needs.
Only once the level of compensation reached a point where it could not reasonably be refused was the claim settled.
The case was successfully concluded by John Bennett, a specialist Personal Injury solicitor at Forbes Solicitors.
The claim settled for £1.5 million, reflecting the serious and lasting impact of the Claimant’s injuries on their life.
