Forbes Solicitors successfully obtained a £25,000 settlement for the estate of a Claimant after the NHS admitted negligence in failing to; follow up on a recommendation for further investigations to the urology service, arrange a referral to the urology service and review records promptly to ensure the referral was actioned.
In 2022, the Claimant was referred to Colorectal Services under the two week rule for suspected cancer. A CT scan revealed no colorectal malignancy but incidentally showed bladder wall thickening. Although a referral to Urology was planned, it was not actioned.
The Claimant later presented with severe right loin pain, prompting their GP to request a CT of the urinary tract. this confirmed the thickening of the bladder wall, leading to a Urology referral.
In 2023, a transurethral resection confirmed the bladder cancer with lymph node involvement. The Claimant was referred for palliative chemotherapy and passed away later that year.
Following the death, their family pursued a clinical negligence claim on behalf of the estate. Although NHS solicitors initially challenging the claim, Forbes Solicitors negotiated a settlement after highlighting the admitted failing and potential impact on the Claimants life expectancy.
John Bennett, a personal injury expert at Forbes Solicitors, secured a settlement of £25,000 for the Claimant’s estate.
