In 2022, the claimant sustained an injury whilst playing football; despite presenting with clear signs of tendon rupture, the Claimant was not referred for surgical reconstruction for several months. The delay resulted in four additional and avoidable surgeries. The claimant has been left with permanent loss of function in their ring finger. This has affected their ability to work and carry out everyday tasks like DIY.
After the incident, the Claimant instructed Forbes Solicitors to investigate a potential clinical negligence claim. Upon being contacted, the Defendant admitted negligence but requested proof of the Claimant’s losses. Forbes Solicitors responded with a counteroffer reflecting the impact of the delayed treatment, which was subsequently accepted.
The case was handled by John Bennett, one of Forbes Solicitors’ leading personal injury specialists. A final settlement of £40,000 was awarded, reflecting the lasting physical and functional damage suffered by the Claimant.
