In a road traffic accident in 2022, a pedestrian was running along the track towards a Farm when the Defendant reversed their vehicle. The driver, later convicted of dangerous driving and other offences, reversed into the Claimant resulting in multiple injuries.
The Claimants dominant right hand suffered fractures and dislocations at the base of the 4th and 5th metacarpals. The injury required manipulation and K-wire stabilisation surgery. Furthermore, the Claimant suffered a superficial leg injury.
Despite medical treatment, the Claimant was left with permanent mild stiffness in the wrist and continued discomfort, especially in extreme temperatures or during strenuous activity. The symptoms will continue to affect their daily activities and work capacity.
The Claimant turned to Forbes Solicitors for legal assistance. Initially, the Defendant’s insurers refused to formally admit liability. Legal proceedings had to be issued, and the Claimant was required to provide detailed evidence of their injuries and losses.
The case was resolved a few days before the court was due to issue case management directions.
John Bennett and Michelle Kemp, from Forbes Solicitors Personal Injury Department, successfully negotiated a settlement of £50,000.
