Runner Injured by Trailing Wire Outside Property Secures £13,500 Compensation

A runner who tripped over a trailing wire outside a residential property successfully recovered £13,500 in compensation after a utility company admitted liability. The claim, resolved through the Rapid Claims Portal, covered facial scarring, private dermatology treatment and future care costs following expert medical evidence.

The Claimant was out running when they tripped over a wire trailing out of a connection box at the side of a property. As a result, they sustained grazing to their face and head. Subsequent attendance at the local emergency department confirmed that there were no fractured bones.

The Claimant made their own arrangements to seek private treatment from a dermatologist to treat the injuries and reduce potential scarring.

The Claimant notified the Defendants of their claim directly before instructing John Bennett at Forbes Solicitors. The Defendant utility company admitted liability and agreed to deal with the claim.

Steps were taken to obtain the Claimant’s medical records. A plastic surgeon was instructed to prepare a report on the Claimant’s injuries. The report confirmed the extent of the Claimant’s injuries and recommended the use of skin camouflage products to disguise the scarring. It was expected that the scarring would diminish over the course of the next 24 months. The Claimant was advised to avoid sun exposure.

The Claimant intended to continue with the treatment via the private dermatologist. The medical report was submitted to the insurers together with details of the private treatment costs already incurred and those expected to be incurred in the future, along with an offer to settle.

The claim was dealt with through the Rapid Claims Portal. The claim proceeded through the Stage 2 settlement process, with the Claimant submitting an offer to settle which was initially rejected. The Defendants counter-offered, proposing a modest reduction on the figures submitted by the Claimant, with an overall difference of £530 between the two figures. The Claimant accepted the counter-offer and recovered £8,500 in general damages and £5,000 in special damages.
