Forbes Solicitors’ Clinical Negligence team has successfully secured compensation for a Client following a serious medication error by a community pharmacy. The claim was made after the Client, who had collected their prescription from Tesco Pharmacy, was hospitalised due to being given the wrong medication.

Shortly after taking the medication, the Client was found unresponsive and admitted to the hospital. Their condition was initially critical, with a fluctuating Glasgow Coma Scale (The Glasgow Coma Scale is a neurological assessment tool used to measure a person's level of consciousness after a brain injury) and symptoms of delirium.

Despite urgent medical attention, the cause of the deterioration remained unknown for a few days. The hospital carried out a series of investigations, including a CT scan under sedation and withdrawal from Fentanyl, as they suspected an opioid overdose. The Client was administered antipsychotics, IV Acyclovir and Ceftriaxone during this period. After four days, it was finally discovered that the wrong medication had been dispensed by Tesco Pharmacy - the diagnosis was medication-induced confusion.

As a result of the error, the Client experienced a significant psychological impact, including a 20% exacerbation of pre-existing anxiety. Medical experts do expect a full recovery within 15 months.

The case was handled by Leonie Millard, an experienced Clinical Negligence and Personal Injury solicitor at Forbes Solicitors. A settlement of £4,000 was agreed, providing recognition for the distress and avoidable harm caused by the dispensing error.
