The incident occurred at night when the Claimant entered the service station from outside the building. As they approached what they reasonably believed to be an open glass doorway, it transpired that it was in fact a fixed glass wall. Due to poor lighting and a lack of clear markings, the glass appeared to be an opening.

As a result, the Claimant collided with the glass wall and suffered; a soft tissue injury to the knee with mild bruising and swelling, soft tissue injury to the nose with bruising and swelling and a small facial wound, leaving a fine scar visible on close inspection.

In addition to the physical injuries, the Claimant was forced to cancel a planned trip abroad.

Following the accident, the Claimant contacted Forbes Solicitors to pursue a personal injury claim. Liability was denied by the Defendant, who relied on photographs taken during daylight hours which made it appear obvious that there was no door.

However, the Claimant’s own photographs, taken in conditions similar to those at the time of the accident, demonstrated that the glass wall appeared to be an opening due to inadequate lighting and insufficient visual warnings.

Court proceedings were issued, alleging that the Defendants were negligent in; causing or permitting the glass wall to remain a danger and a trap, failing to identify the glass wall with hazard warning markings, failing to ensure the approach was adequately lit, marking or colouring the flooring in a way that failed to highlight the presence of a wall and failing to warn the claimant of the glass wall, either verbally or by signage.

The Defendants maintained that the glass wall was adequately marked and obvious. However, prior to the exchange of witness statements, they made an offer to settle the claim.

The claim was successfully settled for £1,000 by John Bennett, a personal injury expert at Forbes Solicitors. The offer was accepted, bringing the case to a conclusion without the need for a court trial.
