When can you contest a Will?
Probate litigation can challenge the validity of a will, even if the deceased was incapable of making a will, was procured with undue influence, or was not executed properly.

Some claims concerning a Will are subject to time limits. However, there is no time limit to challenge the validity of a Will on grounds the deceased lacked capacity to make a Will, or the Will was procured by means of undue influence or it not being executed properly in compliance with the legal formalities. It is still possible to challenge a Will when Probate has been granted. However, it is always sensible to bring a challenge as soon as possible to avoid the Estate assets being dissipated and to collect evidence at an early stage to avoid it being destroyed or lost.
