Spending the necessary time and paying sufficient attention to the principal terms of the lease will help to identify issues that may prevent the transaction from taking place, determine how to structure the transaction and speed up the drafting of the legal documentation. Conversely, problems can often arise if Heads of Terms are not used appropriately, do not capture the true intention of the parties or where they are not full and clear.
