Can both LGBTQ+ parents be listed on a birth certificate in the UK?
Yes – if you’re in a civil partnership or married at the time of conception through assisted reproduction, both parents can usually be listed. If not, we can help secure parental responsibility through legal routes such as parental responsibility agreements or adoption.
What legal rights do co-parents have if they’re not in a relationship?
Co-parents can set out roles and responsibilities in a co-parenting agreement. While not legally binding, these agreements offer clarity on childcare, finances, and expectations, and can be persuasive in any future legal disputes.
How does surrogacy law work in the UK?
Surrogacy is legal but not enforceable by contract in the UK. The surrogate is the legal mother at birth, even if not genetically related. Intended parents must apply for a parental order to become the legal parents. We can guide you through every stage of this process.
Do chosen families have legal rights?
Legal rights typically arise from biological or legal parenthood, marriage, or civil partnerships. However, legal tools such as wills, powers of attorney, cohabitation agreements, and parental responsibility arrangements can help protect your chosen family.
What is a cohabitation agreement and do we need one?
If you’re not married or in a civil partnership, a cohabitation agreement can clarify property ownership, financial contributions, and what happens if you separate. It’s a practical step to avoid legal uncertainty and future disputes.
What rights do cohabiting couples have in the UK?
Cohabiting couples do not have the same rights as married couples or civil partners, regardless of the length of the relationship. However, you may still have claims around property or child support. We can help assess your position and protect your interests.
What legal options are available for same-sex couples going through a separation?
Same-sex couples can access the same legal processes as opposite-sex couples, including divorce or dissolution of a civil partnership. We help navigate asset division, child arrangements, and financial settlements sensitively and fairly.
What are my rights as a grandparent to see my grandchildren?
Grandparents don’t have automatic rights to contact, but they can apply to the court for permission to seek a child arrangements order. The court will consider the child’s welfare and existing relationship with the grandparent.
Can I adopt my partner’s child?
Yes – known as a stepparent adoption, this allows you to become the child’s legal parent. Consent from all existing legal parents is usually needed unless the court decides it’s in the child’s best interest. We can advise and assist throughout.
What is a parenting plan, and do I need one?
A parenting plan sets out how separated parents will raise their child – including living arrangements, holidays and decision-making. Though not legally binding, it encourages cooperation and reduces conflict. It's often the first step before any legal proceedings.
What financial arrangements can I expect during a divorce?
Financial arrangements can include division of property, spousal maintenance, and child support. The court aims for fairness, considering needs, assets, and contributions. We help negotiate settlements and represent your interests if needed.
Can we avoid going to court for family law matters?
Yes – many disputes can be resolved through mediation, collaborative law, or negotiation. Court is a last resort, and we always aim to reach agreements amicably where possible.
How does the law protect children in divorce or separation?
The child's welfare is the Court’s top priority. This includes ensuring a safe, stable environment and maintaining meaningful relationships with both parents where appropriate. We help you build arrangements that prioritise your child’s well-being.
