The Claimant was involved in a road traffic accident (RTA) on their way to work. While approaching a zebra crossing, the vehicle in front of the Claimant’s car stopped. The vehicle unexpectedly reversed into the Claimant’s vehicle.

The Claimant sought legal representation from Forbes Solicitors to claim for the injuries sustained in the collision. Due to the accident, the Claimant was diagnosed with Bursitis of the shoulder, a condition caused by the inflammation of the bursa (a small fluid-filled sac that provides cushioning between bones and surrounding soft tissues).

The Defendant was contacted and admitted to liability for the accident, but the issue of causation was also raised. They disputed that the accident was the direct cause of the Claimant’s bursitis, suggesting that the shoulder condition may have been pre-existing or caused by other factors unrelated to the RTA. In legal claims involving personal injury, causation must be proven to link the injury directly to the accident.

Forbes used medical evidence to demonstrate that the injury was caused by the trauma of the RTA. Medical reports from the Claimant’s healthcare provider, including an Orthopaedic specialist, confirmed that the shoulder injury was consistent with a traumatic event and developed as a direct result of the vehicle impact. The case was handled by Michelle Kemp, a Personal Injury expert at Forbes Solicitors, who negotiated the £1200.00 settlement, ensuring the client was fairly compensated for their pain and suffering.
