Surgery Compensation Case Studies

The claimant underwent microdiscectomy surgery to improve her back pain. The defendant negligently operated on the wrong part of the claimant's back making the problem worse, the claimant was left with permanent back pain.

The defendant admitted negligence. She was unable to return to work and required care and assistance. The claimant underwent a number of unnecessary surgical procedures as a result of negligence and was left with bladder problems, restricted walking and permanent pain.

The claimant recovered a total of £475,000 roughly broken as follows:

  • Injuries £60,000

  • Past losses £65,000

  • Future losses £350,000

The NHS admitted a failure to examine the claimant's retina or refer them for cataract surgery. They argued that the retina was examined and therefore an earlier examination would have made no difference. In relation to the referral for cataract surgery they argued this made no difference to diagnosis of the retinal detachment.

The case was supported by an optometrist and ophthalmic surgeon. Shortly after proceedings were issued the defendant offered the sum of £120,000 which was accepted.

The figure roughly breaks down as follows:
