Clinical Negligence Article

01 September, 2020

It has recently been reported that patients are struggling to book an appointment with their GP because of the current crisis. More than half of patients who have tried to book an appointment, have struggled. In July, all GP practices received a letter from the chief executive of NHS England, advising that they must offer face-to-face appointments at the surgery as well as continuing to use remote triage and video online and telephone consultations where appropriate.

Although general practices have remained open throughout the pandemic, getting to see your GP is far from straightforward. GPs remain under a duty to ensure that they act appropriately and in accordance with the recognised practices of the profession.

If a GP refuses to see a patient and a body of general practitioners take the view that this was unreasonable and outside the acceptable practice of a GP, that could be considered negligent. If that means a serious condition is left undiagnosed, that could give rise to a claim, particularly if an earlier intervention would have made a difference to the outcome.

Here at Forbes Solicitors we deal with many claims against GP practices for failing to carry out timely referrals which can lead to serious complications and progression a condition.

Please contact us if you would like a free no obligation advice on an issue concerning a failure to refer. We work on a no-win no fee basis
