SOLVING PERSONAL LEGAL MATTERS
A no win no fee accident claim refers to a legal arrangement in which an individual can make a personal injury claim without having to pay any upfront legal fees. Instead, the legal fees are paid at the end of the case by the opponent and only if the claim is successful.
Our accident claims solicitors work on a no win no fee basis to help those who have been injured through no fault of their own get compensation.
We are still available and booking appointments over telephone and video conference.
The legal term for no win no fee is Conditional Fee Agreement (CFA). A no win no fee personal injury claims means that you can proceed with an accident and injury compensation claim knowing that if the claim ends unsuccessfully, you don't pay any money to the solicitors.
If we do win, we have a range of options for our fees
£800 including VAT.
In addition to this, with a no win no fee accident claim, we should be able to recover the costs of obtaining a medical report and any other reasonable expenses to prove your losses. We call these disbursements.
If we cannot agree settlement of the claim with your opponent, and it becomes necessary to issue court proceedings, either because we advise you their offer is too low, or the insurers dispute liability, we will have to enter into a separate arrangement to cover the costs of issuing and running the court proceedings.
We can recover our fees from your opponent if the following exceptions apply.
Your injury claim is likely to be worth more than £5,000 or £1,000 if you are a "vulnerable road user"
The following are vulnerable road users :-
If you do not fall into any of these categories and you have suffered other injuries, over and above a whiplash injury, for example, a sprain to a wrist, hand, elbow, knee, ankle, foot, fractured ribs, hearing loss, tinnitus and they are considered to be more serious than a simple whiplash injury, your claim may well be worth more than £5,000. A fracture to any bone is likely to justify an award in excess of £5,000. In that case, costs should be recoverable.
The only deduction from your no win no fee compensation would be our success fee. By law, solicitors are allowed to charge a maximium of 25%. Depending on the case and its complexity, we charge less. Please contact us to discuss this.
Purely by way of example and to give you an idea as to how the success fee works. If you were to recover a figure of say £10,000 - If £5,000 of that represented your past losses, as at the date of settlement, and the remaining £5,000 represented your future losses, the success fee of 20% would be £1,000. If, however the case settled very quickly and our costs were limited to £600, then the success fee would be limited to 100% of those fees i.e. £600. If our costs were £2,000 then the success fee would be limited to 20% of your past loss i.e. £1,000
