Lasting Power of Attorney Refund Scheme Launched

The Ministry of Justice have launched a scheme to refund those who may have overpaid to register their Lasting Powers of Attorney (LPAs).

For LPAs registered with the Office of the Public Guardian (OPG) between 1 April 2013 and 31 March 2017, a partial refund of the registration fee is available. This is because the OPG's processing costs have reduced and the system has become more efficient.

A refund can be claimed online via the GOV.UK website. For those without access to the internet, claims can also be made over the telephone. The scheme will be open for three years from 1 February 2018.

Refunds will be paid directly to the Donor (the person who made the LPA), although an Attorney can apply on the Donor's behalf. Where an LPA was prepared by a Solicitor, the OPG will not refund via the Solicitor, so clients are advised to apply to the OPG direct.

Executors can claim a refund on behalf of the estate of a Donor who has passed away. However, this cannot be done using the online system and Executors will need to telephone the OPG to process their claim.
