In 2005, aged 59 at the time of the accident, a lady was a front seated passenger in a stationary vehicle when it was struck in the rear by a vehicle driven by the Defendant.
Liability for the accident was admitted by the Defendant.
Following the accident she attended the Accident and Emergency department at the local hospital where she was diagnosed as having suffered a whiplash injury to her neck and back. A pre-existing back problem meant that her back pain was made much worse.
She suffered with neck pain for up to 18 months after the accident, though her back pain continued for a further 6 months, over two years after the accident.
3 years after the accident, at the age of 62, the Claimant was awarded £6,860 in compensation.
