A 42-year-old man received £1,600,000 in compensation for the neurological injuries that he sustained as a result of negligent hospital treatment.
In February 2004 he attended hospital for a review of his injuries received in a road traffic accident four months previously. An MRI scan was performed which showed a protruding disc in his spine, which was compressing a nerve root.
Some seven months later, in September 2004 he underwent surgery for the disc to be removed. During the surgery, the surgeon was unable to locate the disc.
Following the operation the man began to complain of a loss of sensation in his lower limbs. Another date for a further operation was arranged for a week later. As with the first, this second operation proved just as unsuccessful.
His loss of use in his lower limbs was permanent, with no prospect of improvement.
The Claimant brought a claim against the hospital alleging that had they had been negligent for failing to perform surgery at two levels and also failing to recognise his condition as one that required emergency surgery. His claim was successful on that basis.
